If you order through netformx or DCT, it will add the license for you.  However, if you are not a DVAR with Cisco, as Jochen pointed out you'll need to make sure the $0 item is part of the order.  Even if you buy the Layer 3 LAN license and apply it you'll still need the base.  If you end up applying the LAN license w/o base, you'll be able to configure everything and it will appear correctly in the running-config, but will work either very slowly or not at all.  It's definitely a frustrating TAC call.
